Rochester,MN (KROC AM News) - A 40 year old Rochester man was arraigned Wednesday as the suspect in a brutal assault that happened earlier this week near the Salvation Army Center along 1st Ave NE.

It happened around 8:30 a.m. Monday during a dispute between Phillip Smith and the 53 year old victim.

The victim says Smith began punching him in the head and he was knocked to the ground. He says Smith continued punching him and then began stomping on him.  Smith eventually left and the victim called police.  He was later treated for a fractured ankle and facial injuries.

During his court appearance, Smith’s bail was set at $15,000 and he was ordered back for another hearing August 19th.
