St. Paul, MN (KROC-AM News) - The Minnesota Court of Appeals has ruled that a Minnesota law that makes it a crime for a drunk driving suspect to refuse a blood test is unconstitutional.

The ruling stems from a case involving a repeat drunk driver who was given a five-year prison sentence after he refused to voluntarily submit to a blood test following his arrest in Ramsey County in 2012. The Appeals Court found that taking a blood sample without an individual’s permission or a search warrant violates constitutional protections against unreasonable searches and seizures and a citizen’s right to due process.

The case is expected to be appealed to the Minnesota Supreme Court.
