Rochester, MN (KROC AM News) -  The Minnesota Court of Appeals has overturned an Olmsted County judge’s decision to grant a name change request for a young boy whose father is serving a 97-month prison sentence for a child pornography conviction.

The father, Nicolai Quinn, filed the appeal after the judge approved a request from the child’s mother to change her son's last name to match his stepfather’s name following the mother’s marriage to him in 2014. In overturning that decision, the appeals court found the judge abused the court’s discretion by failing to apply the proper standard in granting a name change over the birth father’s objections.

The ruling also noted the mother did not make any effort to change the child's last name after the father was convicted in 2012 or when he agreed to give the mother physical and legal custody of their child.
