Rochester, MN (KROC AM News) - A 40-year-old Rochester man has been sentenced to 6 ½ years in prison for convictions stemming from a drive-by shooting last fall.

Joshua Cunningham earlier admitted to a drive-by shooting charge and a related charge involving the possession of ammunition through a plea agreement that resulted in the dismissal of three other felony charges, including second-degree assault with a dangerous weapon.

He was accused of firing at least 15 bullets from an AK-47 into a home and a car in northwest Rochester last October. He was arrested a couple hours later after the homeowner identified Cunningham as a possible suspect because they had been involved in an earlier dispute over a debt. The criminal complaint indicated the case against Cunningham was solidified when he made a phone call to another man from the Olmsted County jail asking about the AK-47. The other man later admitted to investigators that he was given the gun by Cunningham shortly after the shooting and he hid it in the trunk of his car.

The police reports on the case say there were three juveniles inside the home that was targeted in the shooting, but no one was hurt even though bullet holes were found in two bedrooms and a bathroom.
