Rochester, MN (KROC AM News) – One of the two men charged with attempting to break into a Byron home in broad daylight while an 11-year-old boy was inside the residence has entered into a plea agreement.

47-year-old Philip Bartlett appeared in Olmsted County Court Thursday and admitted to a first-degree burglary charge. In exchange, prosecutors dropped two other burglary-related felony counts that were filed against the Hayfield man.

He and 47-year-old Todd Bauer of Byron were arrested in early April after the 11-year-old boy called 911 and reported that two men were trying to break in through a window in his family’s home. The responding deputies used a police dog to track the pair to a nearby garage, where they were arrested.

Bartlett is scheduled to be sentenced on July 6th, while the case against Bauer is still pending.
