Conviction for Deadly 2012 Crash Upheld
St. Paul, MN (KROC-AM News) - The Minnesota Court of Appeals has upheld the conviction of an Austin area man on charges stemming from a deadly alcohol-related car crash in 2012.
46-year-old Jason Fredrickson of Elkton was found guilty of criminal vehicular homicide for causing the deaths of two men by driving drunk and a high rate of speed. Investigators estimated the vehicle was traveling at over 120 mph when the crash occurred just south of Austin. All three men were ejected.
Fredrickson, who was sentenced to 96 months in prison, argued that the results of a blood-alcohol-concentration test should not have been allowed in his trial because the sample was obtained without a warrant while he was hospitalized in critical condition, and that there was insufficient evidence to prove he was driving the car at the time of the crash.
